  • Legal assistance provided to one of the largest private providers of medical services in Romania in relation to the Competition Council regarding the authorization of economic concentrations resulting from the acquisition of two private operators of medical services.

 

  • Legal assistance also regarding the institutional and public communication strategy granted to one of the largest investors and real estate developers in Romania and EEC regarding a legislative project with a possible major negative impact for the relevant market.

 

  • Legal assistance for the transfer of significant activities of a large electronic communications network operator to a top profile player. Dima & Asociații assisted in negotiating and concluding the transaction in the quarter. IV 2019. At the same time, our company provided legal assistance and representation to the authorization in July 2020 of the economic concentration by the Competition Council.

  • Legal assistance granted to a large telecom and TV program distribution operator in liaison with the Competition Council, with respect to regulation of the “must-carry” obligation in the audio-visual legislation.
  • Assistance for a food production company in an investigation by the Competition Council.
  • Assistance of a major Romanian telecom operator in regulatory dealings with the Competition Council with respect to launching innovative telecom services.
  • Successful creation and implementation of the legal strategy of a major telecom operator in a major dispute with the Competition Council, regarding a sanction with the initial value of Euro 22 million (subsequently reduced by the Competition Council by half) having as result the complete annulment of the sanction imposed by the authority.
  • Successful elaboration and implementation of the legal and communication strategy of a major telecom operator during an investigation initiated in 2006 by the Competition Council at the complaint of another operator. Consequently, the Competition Council issued a decision in 2012 by which it closed its investigation on the possible breach of article 6 from Competition Law 21/1996, without dictating any sanctions against the operator. In the same complaint file, other operators were sanctioned with fines amounting to Euro several tens of millions.
  • Successful elaboration and implementation of the legal and communication strategy with the Competition Council for a major telecom operator in connection with several acquisitions performed by the latter.
  • Assistance of a major telecom operator in the process to finalize through commitments the investigations initiated by the Competition Council in connection with the distribution of pre-paid cards. In 2012, the Competition Council accepted the proposed commitments, the case thus creating an important precedent in the application of competition law in Romania, the chosen solution being expected to produce positive effects on the market, in the benefit of mobile telephony services users. Dima & Asociatii is also involved in the process of monitoring the fulfillment of the agreed commitments.
  • Successful creation and implementation of the legal and communications strategy in relation with the Competition Council for a top supplier of cinematography services regarding a potential economic concentration operation.
  • Successful assistance of a large telecommunications operator in the file in which the Competition Council investigated the market of electricity branching services for consumers and the market of rental services for aerial low & medium voltage electricity line poles for the purpose of installing telecommunications networks. The Competition Council closed the investigation in 2011 rejecting the initial complaint, without dictating any sanctions to the respective operator.
  • Counseling the largest supplier of private medical services in a competition law issue regarding the change from jointly exerted control to sole control.
  • Consultancy granted to a large telecommunications operator with respect to implementing an international agreement for joint acquisitions.
